ShapeAI – Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern the use of the ShapeAI mobile application ("App"). By creating an account and subscribing to ShapeAI, you agree to these Terms in full. If you do not agree, you may not use the App.

2. Service Description

ShapeAI provides AI-based body analysis and progress tracking through its mobile application. The App allows users to analyze their body, view progress over time, and compare results. ShapeAI is not a medical service and should not be used as a substitute for professional medical advice.

3. Eligibility

ShapeAI is available to users worldwide. There are no legal age restrictions, but users must have the legal capacity to enter into binding agreements.

4. Account Registration

To access ShapeAI’s features, users must create an account using their email and password and maintain an active subscription. Users are responsible for keeping their login credentials secure.

5. Subscriptions and Payments

All services are available only through an active subscription. The available plans are:

• Monthly plan: $4.99 per month
• Yearly plan: $35.99 per year

Payments are processed securely through Stripe. Invoices are automatically issued by Stripe and sent via email. Subscriptions renew automatically unless canceled by the user.

6. Cancellation and Termination

Users may cancel their subscription at any time through the in-app profile page. Upon cancellation, the account will be deactivated but not deleted. Users may reactivate their account at any time by purchasing a new subscription.

7. No Refund Policy

All payments are final. ShapeAI does not provide refunds or partial reimbursements under any circumstances.

8. User Content and Photos

Users upload personal photos for body analysis. These photos are stored permanently to provide accurate long-term statistics and progress tracking. By using the App, users grant ShapeAI a non-exclusive right to process and use these photos for AI model improvement and service optimization purposes.

9. Intellectual Property

All content, algorithms, and designs within the App are the intellectual property of ShapeAI. Users may share screenshots and personal results publicly, but may not copy, reproduce, or use the App’s AI system for commercial or competitive purposes, including training other AI models.

10. Medical Disclaimer

ShapeAI provides visual and statistical feedback based on user-submitted photos. The App does not diagnose, treat, or prevent any medical condition. All results are for informational and entertainment purposes only.

11. Limitation of Liability

To the maximum extent permitted by law, ShapeAI and [Your Name] are not liable for any direct, indirect, incidental, consequential, or special damages arising from the use of the App, including but not limited to personal injury, loss of data, or loss of profits.

12. Privacy

ShapeAI handles user data in accordance with its Privacy Policy. By using the App, you consent to the collection and processing of your personal data as described therein.

13. Modifications and Updates

ShapeAI reserves the right to modify these Terms at any time. Users will be notified of material changes via email or in-app notification. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany. Any disputes arising from these Terms shall be resolved in the competent courts of Berlin, Germany.
